COURT PROCEEDINGS FOR POSSESSION OF PROPERTY AND FEES
Notices
We can prepare and serve the appropriate Notice, required by law, demanding possession of the property by the appropriate date and, if required, demanding payment of rent arrears.
In cases other than rent default and accelerated proceedings, please contact us for our terms and fees.
Proceedings
If the tenant does not comply with the Notice, we will, if instructed to do so, draft a Claim Form, Particulars of Claim, current schedule of rent arrears and a witness statement. We will seek a Possession Order and, where appropriate, Judgment for the arrears.
Possession
If the tenant fails to vacate the premises after the date ordered by the Court, it will be necessary to instruct a Bailiff. We will prepare and file an application form. You or your agent will need to attend the Bailiff's appointment and it is advisable to have the locks changed when the tenant has finally vacated the premises.
Fees
If the claim for possession is undefended the following fees apply:

You will need to provide a copy of the Tenancy Agreement and schedule of rent arrears.
If the claim is defended, work will be charged on our normal timed basis.
