Our inheritance tax solicitors provide expert legal advice tailored to your individual circumstances, offering clear and compassionate support at any stage of life or circumstance, whether you are planning ahead or dealing with matters following a bereavement.
For clients who are planning ahead, we provide clear guidance on how inheritance tax applies to their own estate and what steps can be taken to manage potential exposure. This includes reviewing the value and structure of assets, discussing family circumstances and future intentions, and advising on inheritance tax planning options that are appropriate for you. Early advice allows you to plan in a tax-efficient way, while maintaining control and flexibility during your lifetime.
Administering an estate carries significant legal and financial responsibility. We support executors throughout the estate administration process, helping them understand how inheritance tax applies to the deceased’s estate, what needs to be reported to HM Revenue and when tax must be paid. Our role is to calculate inheritance tax correctly, meet deadlines and distribute the estate to beneficiaries without unnecessary delay or risk.
Inheritance tax calculations can be affected by a range of reliefs, exemptions and tax free allowances. We carefully review each estate to identify what applies, including the nil rate band, residence nil rate band, spouse or civil partner exemptions and reliefs relating to business or agricultural assets. Ensuring these are applied correctly can make a significant difference to the overall inheritance tax liability.
Our inheritance tax solicitors advise on practical ways to reduce tax liabilities, both during lifetime planning and as part of estate administration. This may involve advice on lifetime gifts, trusts or ownership structures, always with careful consideration of wider implications such as capital gains tax or income tax. Our focus is on providing balanced, legally valid advice that protects your interests and those of your beneficiaries.
Beneficiaries can sometimes face uncertainty about their position, particularly where inheritance tax has not yet been settled or gifts are involved. We provide clear advice to beneficiaries, explaining their rights, responsibilities and any tax implications they may need to be aware of. This helps avoid misunderstandings and supports a smoother administration process.
Inheritance tax matters often overlap with financial planning, accounting and valuation issues. Where appropriate, we work closely with financial advisers and other professionals to ensure advice is aligned and the overall approach is consistent. This joined-up way of working helps deliver the best outcome for our clients, providing clarity and reassurance throughout.
Whatever your circumstances, you can rely on Walker Foster for dependable, well-informed support with inheritance tax matters. Our focus is on protecting your position, explaining your options clearly and guiding you through the process with care, professionalism and confidence.
At Walker Foster, we pride ourselves on delivering a friendly, approachable and professional service, providing clear and practical inheritance tax advice at what is often a sensitive and emotionally challenging time.
Every client’s situation is different, and effective inheritance tax advice begins with taking the time to understand your own estate in full. This includes the nature and value of your assets, such as property, savings, investments and business interests, as well as your family circumstances, beneficiaries and future intentions. By building a detailed picture from the outset, we can identify potential inheritance tax issues early and tailor our advice to support your personal goals, whether that is protecting the family home, providing for a surviving spouse or civil partner or preserving wealth for future generations.
Inheritance tax involves a combination of tax rules and legal principles that can be difficult to navigate without specialist guidance. We believe it is essential that you fully understand how the law applies to your situation. Our solicitors provide clear, straightforward explanations of complex inheritance tax rules, including thresholds, exemptions, reliefs and deadlines, so you can make informed decisions with confidence. We avoid unnecessary jargon and ensure you always know where you stand and why certain advice is being given.
Our role is not simply to explain the law, but to help you use it effectively. We focus on identifying tax efficient solutions that are fully compliant and legally valid, reducing the risk of future challenges or unexpected liabilities. This may involve advising on inheritance tax planning, lifetime gifts, trusts or reliefs, always with careful consideration of wider implications such as capital gains tax or income tax. Our advice is practical, balanced and tailored to your circumstances, ensuring any steps taken are sustainable and appropriate for you.
Clear communication is central to our service. Whether we are advising on inheritance tax planning during your lifetime or supporting you through estate administration, we keep you informed at every stage. We explain what needs to be done, when action is required and what to expect next, helping to reduce uncertainty and stress. Our aim is to provide reassurance and continuity, so you feel supported from initial instruction through to completion.
We understand that cost is an important consideration when seeking legal advice. That is why we are transparent about our pricing from the outset. We explain our fees clearly, including when work is charged at an hourly rate, and ensure you understand the scope of the advice being provided. This openness allows you to plan with confidence, without concerns about unexpected costs.
Inheritance tax law is constantly changing, and our specialist solicitors stay up to date with developments in legislation, HM Revenue guidance and best practice. This commitment ensures the advice you receive is accurate, reliable and reflects the current legal landscape.
At Walker Foster, we are trusted by generations to provide advice that is clear, supportive and focused on delivering peace of mind.
The seven-year rule relates to how inheritance tax is applied to gifts made during a person’s lifetime. In simple terms, if you make a gift and survive for seven years from the date the gift is made, its value will usually fall outside your estate for inheritance tax purposes and no inheritance tax will be payable on that gift. These gifts are known as potentially exempt transfers.
If the person who made the gift dies within seven years, some or all of the value of the gift may be brought back into the estate when calculating inheritance tax. The amount of tax payable can depend on how long the person lived after making the gift, with taper relief sometimes reducing the tax due if death occurs more than three years after the gift was made.
The UK inheritance tax limit is currently set at £325,000, known as the nil rate band. This means that, in many cases, an estate valued at £325,000 or less can be passed on without any inheritance tax being payable. The threshold may be higher where additional allowances apply, such as the residence nil rate band when a main residence is left to lineal descendants, or where assets pass to a spouse or civil partner, which are generally exempt from inheritance tax.
Any unused allowance can often be transferred to a surviving spouse or civil partner. As a result, the effective inheritance tax limit can vary depending on personal circumstances, family arrangements and how assets are distributed, making it important to seek advice from inheritance tax planning solicitors to understand how the rules apply to your estate.
Reducing inheritance tax often requires careful forward planning and an understanding of the options available. Inheritance tax planning can include making lifetime gifts in a tax-efficient way, using trusts to control how assets are passed on, and taking advantage of reliefs and exemptions that apply to certain types of assets, such as business or agricultural property. Allowances such as the nil rate band and residence nil rate band can also play an important role in reducing the amount of tax payable. Each option has specific rules and potential implications, and when used incorrectly can lead to unintended consequences.
At Walker Foster, our experienced solicitors provide specialist legal advice so that any steps you take are legally valid, tailored to your individual circumstances and aligned with your wider estate planning goals, giving you confidence that your arrangements are both effective and secure.
