Purchasing property

  • Instruction and initial steps: once your offer has been accepted, you formally instruct Walker Foster as your conveyancing lawyers. We will open your file, provide you with our initial paperwork and make contact with the seller’s lawyer to confirm that we are acting on your behalf. At this stage, we outline the home buying process, explain what to expect, and answer any initial questions you may have.
  • Contract pack and searches: when we receive the draft contract pack from the seller’s lawyer, it will include key documents such as the contract, property information forms and a copy of the legal title. We then arrange a series of property searches, covering matters such as local authority planning, drainage and water connections, environmental concerns, and any potential restrictions affecting the property. These checks are essential in identifying any issues before you commit to the purchase.
  • Enquiries and mortgage offer: once all documents and search results are reviewed, we raise any necessary enquiries with the seller’s conveyancing lawyers to clarify outstanding matters or resolve potential risks. During this time, you will need to secure your formal mortgage offer. We will review this document carefully to confirm that the terms align with your expectations and that all lender requirements are met.
  • Report on title: after all enquiries have been resolved and we are satisfied that everything is in order, we will prepare and send you a detailed Report on Title. This document summarises our findings in clear, accessible language, outlining any key points you need to be aware of and explaining the terms of the contract. Our goal is to give you complete confidence in your decision before moving forward.
  • Exchange of contracts: this is the point at which the transaction becomes legally binding. You will pay a deposit, and we will exchange signed contracts with the seller’s lawyer. From this moment, both parties are committed to completing the sale, and a fixed completion date is agreed.
  • Pre-completion: in the days leading up to completion, we request the mortgage funds from your lender, carry out final pre-completion searches, and prepare a detailed financial statement for your approval. We also confirm all final arrangements to make sure everything is in place for completion day.
  • Completion day: on the agreed completion date, we transfer the remaining purchase funds to the seller’s lawyer. Once they confirm receipt, the estate agents are authorised to release the keys to you. This marks the moment you officially become the owner of your new home - a significant and rewarding milestone.
  • Post-completion: following completion, our team will handle all remaining formalities. We pay any Stamp Duty Land Tax (SDLT) due on your behalf and submit the necessary documents to the Land Registry to record you as the new legal owner of the property. We will then provide you with confirmation once registration is complete, bringing the process to a smooth conclusion.

Selling property

  • Instruction and property forms: once you instruct our experienced residential conveyancing team to act on your behalf, we will begin by opening your file and guiding you through the initial paperwork. You will be asked to complete detailed property information and fittings and contents forms, providing key details about the property, boundaries, fixtures, and any recent works carried out. These forms form part of the contract documentation that will be shared with the buyer’s legal representatives. We will also ask you to supply any necessary documents, such as planning permissions, building regulation certificates, guarantees, and title deeds, to help avoid delays later in the process.
  • Preparing the contract pack: once we have received your completed forms and documents, our conveyancing lawyers will prepare the draft contract and assemble the contract pack. This comprehensive set of documents, which includes the contract, title information, and property details, is then sent to the buyer’s legal team. We take great care to make sure the pack is accurate and complete, helping to keep the process moving smoothly.
  • Answering Enquiries: After reviewing the contract pack, the buyer’s conveyancing lawyers may raise a series of enquiries about the property.
